The next case was a motion by the Registrar of Titles to rescind an order by. Mr. Justice Burnside, dated March 3 1913, in respect to the transfer of certain land at Cottesloe.
Mr. Justice Burnside in March of this year, on the application of Joseph Henry Barsden and Walter Stephen Finey, order- ed, after hearing the application, that the respondents (the Registrar of Titles and the Commissioner of Titles) should register, or cause to be registered; a transfer of the said land--Cottesloe lot 166-from William Pil- ling; Charles R. Farrington, and Richard Cole Sinclair-to the applicants free from encumbrances.
The pleadings set forth that on October 11, 1897; a Crown grant was issued for Cot- tesloe lot 55 and on September 18, 1893, for Cottesloe lot 56. The United Friendly Societies of Fremantle, in whose favour the grant was made for recreation purposes, ex- pended about £400 in levelling the land, but found it unsuitable for recreation pur- poses, and on September 7, 1907, a Crown grant was issued for the lots in question to William Pilling, Charles Ralph Farrington, and Richard Cole Sinclair, who executed a declaration of trust to the effect that they held the land on trust, to sell and apply the proceeds for the purchase of other land at Fremantle, and the erection of a medical hall thereon for the Friendly Societies. The Registrar of Titles lodged a caveat against the title to protect the declaration of trust. In January last Joseph Henry Baraden pur- chased the lots now known as Cottesloe 166 from the registered owners for £2,300 for himself and Walter S. Finey, and a proper transfer was executed. The Commissioner of Titles, however, refused to register the transfer. It was contended that on March 1, 1907, the trustees of the land surrendered it to the Crown, and that on August 28, 1907, the Governor-in-Council approved of a proclamation revesting the same in the Crown, a Crown grant for the lots being issued to William Pilling, Charles Ralph Farrington, and Richard Cole Sinclair as jont tenants.
Dr. Stow appeared for the appellant, Mr. M. L. Moss, K.C., for the Friendly Socie- ties, and Mr. R. R. Pilkington, K.C., for other respondents.
Addresses by counsel had not been con- cluded at 4 p.m., when the Court adjourn- ed until 10.30 a.m. to-day.
