BENCH AND BAR. Pleasantries in Court. There was some amusing give- and-take between Judge and counsel in the Criminal Court yesterday, after an elderly Irishman, James Clancy, had pleaded guilty to a charge of having unlawfully wounded Donald Gower Mann, a member of the WA Police Force, at Dalwallinu on July 7.
Mr H. Haynes, for the accused, urged upon the Chief Justice (Sir, John Northmore) that in the cir- cumstances of the case the ends of justice would be fully met if Clancy were released on bond. On the night of July 7 he knocked, with the handle of a knife, on a door of the Dalwallinu Hotel, where he wanted lodging for the night. The local constable emerged from the bar, and in a scuffle which en- sued the constable received some minor injuries. There was no sug- gestion that Clancy deliberately drew te knife to inflict wounds. Ever since he arrived in this state from Ireland in 1912 he had been em- ployed as a farm hand in the Dal- wallinu district, where he was widely known and respected as a quiet, peaceable citizen-anything but a belligerent type.
Clancy's employer, a farmer, said that be would willingly act as bonds- man for Clancy, who was described by him as "a splendid man, abso- lutely trustworthy and clean-living, who would not hurt a fly." Strong language was not infrequent in the bush, when men were confronted with the various difficulties of out back life, but it was characteristic of Clancy that he never swore, what ever the provocation. When annoyed he occasionally said "Dash!" No- body had ever heard him use a stronger epithet than that.' He was known far and wide as "the Gentleman."
Mr Haynes said that on the occasian in question Clancy ad- mittedly had "a few drinks below the belt," but he was by no means drunk.
The Chief Justice: A pity "the Gentleman's" drinks did not stay below the belt. Perhaps they went higher up-to his head, in fact.
Mr G. B. D'Arcy (for the Crown) mentioned that among the con- stable's injuries had been a scalp wound.
The Chief Justice: Was it really a scalp wound? We had a constable here once who said he had such a wound, but it turned out to be a scalp wound on his leg. Was this ome of that sort, by any chance?
Mr D'Arcy: No-a genuine scalp wound.
Mr Haynes: A doctor said it penetrated to the bone. We all know that a wound on the scalp would have to go only an infinitesi- mal distance before penetrating that far!
The Chief Justice: I don't know. It all depends on whether the con- stable was fat-headed.
Clancy was remanded for sen- tence.
