Tenancy Case
Albert David Charles Bynon (agent
for Jessie May Bynon) v. N. Ditch-
burn, applying for possession of pre-
mises situated in Twynam Street,
Narandera,
Mr. L. L. Henderson appeared for
the lessor.
Mr. Cherry Willis (Leeton) appear-
ed for defendant, who pleaded cause
to show.
Mr. Willis said that after receipt of
the notice to quit defendant Ditchburn
by deed assigned the residence of the
weekly tenancy to Albert Leslie
Cramp. Notice of that assignment was
given to the landlord's agent, Mr. J.
R. Moore, and also to the landlady
(Mrs. Bynon). The premises were oc-
cupied at present by Mr. Cramp and
his wife and eight children, and liv-
ing with him was his father-in-law
(Mr. N. Ditchburn), two sons, and a
widowed daughter and three children.
There were 17 altogether living in the
house. Cramp was a returned soldier.
Mr. Henderson said that it appeared
to him that that had happened to beat
the regulations. Defendant, as far as
they were concerned, was a man nam-
ed Ditchburn. It appeared to him to
be a racket to beat the landlord. The
same thing could happen every time
a notice to quit was issued. He did
not think Mr. Cramp had any stand-
ing in the matter, despite the assign-
ment. They based their summons on
the notice to quit served on Ditch-
burn.
Mr. Willis said that about 10 years
ago Cramp was a tenant. Then it re-
verted to the father-in-law's name,
and now it had again reverted to
Cramp.
The Bench: They are both new ten-
ancies.
An adjournment for a short while
was granted.
On the case being resumed, Mr.
Willis said that Mr. Ditchburn was in
the premises.
Mr. Henderson said that when the
property was purchased Ditchburn was
the tenant and was the tenant when
notice to quit was served. He then as-
signed the tenancy.
After a further short adjournment,
Mr. Willis said that his client would
consent to an order to vacate on or
before 7th April.
An order was made for a warrant
of possession to put the lessor in pos-
session of the premises within the
period commencing 3rd April, and end-
ing 10th April. The issue of the war-
rant to be postponed until 2nd April.
Defendant was ordered to pay an
occupation fee of £1 per week.

Narandera will shortly lose 17 resi-
dents in one batch. Mr. Norm Dich-
bum has decided to take his departure
after a residence of over 20 years,
during most of which time he has
been an employee of the Municipal
Council. With him will go members
of his family, including two sons,
Stan and Ref; Mr. and Mrs. Les
Cramp and their 10 children, and Mrs.
Allen and her three children. Mrs.
Cramp and Mrs. Allen are Mr. Ditch-
burn's daughters.
