LISMQRE
MAN FAILS
IN CLAIM
An action by a Lismore man
claiming £300 damages for in-
juries sustained as the result of
an accident was unsuccessful
in Lismore District Court yes-
terday.
The claim was made by
Francis Henry Walker, shoe re-
pairer, of 37 Terania Street,
North Lismore, against Escott
Gordon Bulmer and Laurence
Neil Bulmer, carriers, of
Bangalow.
Judge Storkey, V.C., said he
was not certain how the acci-
dent happened, but Walker had
not shown that the Bulmers
were liable.
He gave a verdict for the de-
fendants.
Walker said he was driving
his motor cycle and sidecar on
the road between Bangalow
and Mullumbimby near the
Bangalow cemetery on May 19.
There was a friend riding
pillion and his wife and two
children in the sidecar.
He was travelling on the cor-
rect side of the rodd about 10
miles per hcur. A truck was
coming towards him travelling
on the incorrect side of the
road. He called out to the
driver, who was not watching
the road. He then pulled fur-
ther over to the left, and the
truck struck the brake handle
of his machine, causing an in
jury to his wrist, said Walker.
When questioned as to why
he was not watching the road,
the truck driver said he was
watching a horse, said Walker.
He said he was employed as
a casual shoe repairer on four
days a week, for which he re-
ceived £7/17/-. He also did
shoe repairing at home.
His total net earnings
since July, 1950, to the date of
the accident were £132/7/10 for
the work he did at home.
He had not been able to
follow his casual employment
since the accident, added
Walker.
Bulmer indicated the point of
the impact as the centre of the
roadway, Walker told Mr.
Hungerford.
He could not pull further
over to the left without the
danger of running into a bank.
Broken glass on the road
was from his rear vision mirror.
The glass was on his side of
the road, said Walker.
At the time he made a state-
ment to a policc constable no
mention was made of the glass,
added Walker.
Shirley Jane Walker said the
truck was at least two feet
over the centre line when the
impact occurred. Most of the
broken glass was on her hus-
band's correct side of the road
immediately following the
accident.
Const. R. W. Crapp said the
rear vision mirror on the
motor cycle was protruding
three inches from the handle
bars. The broken glass was
lying along the centre of the
roadway.
To Mr. Furnell, Const. Crapp
said Walker would not indi-
cate a particular point of im-
pact, but insisted it was fur-
ther over on the western side
of the road than the spot indi-
cated by Bulmer.
Laurence Neil Bulmer, truck
driver, of Bangalow, denied he
was watching a horse or that
he had told Walker he was do-
ing so. The broken glass was
lying in the centre of the road-
way for a distance of four or
five feet, he added.
Mr. L. C. Furnell, instructed
by Mr. W. p. Walters, of
Trench, Walters and Co., ap-
peared for Walker, and Mr. G.
P. L. Hungerford, instructed by
Mr. R. Balzer, of Mcintosh and
Balzer, appeared for the
Bulmers.

There are other people in this site, for various reasons, some not related at all. Some are married into my family, some I once thought were related and, turns out, they are not.

On the Aborigines: Unfortunately, I can only place global statements not he web pages. The aborigines I am aware of are in the Blackman Line and are from the children of James Blackman and Elizabeth Harley.
