SMALL DEBTS COURT.
Richard Marks sued certain officers of the
Laggan races on 26th January last, of which T.
Francis and R. Dooley were two, for the amount of
a prize which was alleged to have been paid to one
who had previously run his horse on an unregistered
course, and had thus unlawfully obtained the prize
money.
Mr. Carter, who appeared for the defendants,
pleaded not guilty; but the plaintiff,: being totally
unable to conduct his case, was non-suited, the
bench remarking that so peculiarly intricate a case
should never have been brought into court without
the assistance of a legal adviser, and the plaintiff
was reminded that he still possessed power to do so
should he think fit.

Alleged Cattle-stealing.
At the Murrumburrah Police Court on Thurs-
day, Richard Marks was brought up on remand
before Messrs. S. Robinson, P.M., and T.
Barnes, J.P., for being in possession of 32 head
of cattle reasonably supposed to have been
stolen. From the evidence of Constable Collins,
it appears that his attention was drawn on the
19th of January to the movements of Marks,
whom he found to be in charge of the cattle,
travelling without a permit, and unable to
produce the usual sale note. The defendant
also gave a wrong name, that of William Brown.
His different explanations being very contradic-
tory, his detention was considered necessary. He
alleges having bought the cattle for £90 on
the road from Dalton, from a man named Ryan,
whom, he admits, being unable to know again
by sight. He had completed the sale of them in
Murrumburrah for £104; but the agent, Mr.
Bourke, in whose hands the cattle were placed
for sale, having communicated with Constable
Collins, deemed it unadvisable to hand over the
money, and Marks was at once apprehended.
The police not being prepared to conclude their
case, applied for a remand until the 3rd instant,
which was granted, bail being refused. The
cattle are branded C over K, JML, WD over D,
PD over O, HB over O, PDO over O, HM, HB
over H, and several young ones are unbranded.
On Thursday last, before the P.M. and Mr. T.
Barnes, J.P., Marks was brought up on a charge
of cattle-stealing. Mr. A. Betts, of Goulburn,
appeared on behalf of the prisoner. The
evidence given by Constable Collins and Mr. J.
Bourke at the previous trial was read. Mr. Hay,
of Woodville, claimed 11 of the 32 head of
cattle in the possession of the police as his
properly, and said they were portion of a lot
purchased by prisoner, a Mr. Paget, and himself
at a cattle sale, in Goulburn, about three years
ago. Mr. Hay stated that he had known Marks
for about fifteen years, and, as far as he (Hay)
knew, always bore an excellent character.
Another witness, Mr. Bray, who resides near
Crookwell, also recognised some of the cattle,
which he believed were the property of Mr Hay.
The prisoner, who reserved his defense was
committed to take his trial at the Quarter
Sessions, to be held in Yass on the 14th instant.
Mr. Betts applied for bail, which was granted
as follows-- prisoner in £200, or two sureties of
£100 each.--Signal.

to skin dead carcases in my paddock, and so have
J. Eldridge and Richard Marks (my manager) ; they
must account for all the skins disposed of ; I cannot
swear that they have not sold the hide produced;
the distance of the carcase from your place may be
more than a mile.
Richard Marks identified the hide as one from a
cow of Mr. Hay's.

After payment of all my just debts funeral and testamentary expenses, I give and devise unto my dear wife, Lydia Marks, all that my land and cottage situated at Crookwell and lately purchased from my son Sydney James Marks subject to having paid the balance of purchase money (if any) due thereon and at the time my death. I also give, devise and bequeath to my said wife all my interest in and all money due (if any) on my property at Orange recently sold by me. I gave and bequeath to my said wife all moneys in hand or standing to my credit in any bank, either on current account or on deposit. I give and bequeath all moneys due under any policy or policy of insurance effected in my life to my said wife and all my children to be equally divided between them. All the rest and residue of my estate whatever and whereever soever situate I give and devise and bequeath to my dear wife, Lydia, and during her lifetime and from and after her death to all my children, Charles Henry Alfred Marks, Elijah Reuben Marks, Sydney James Marks, Hannah Maria Marks, Arthur Ambrose Marks and Percival Richard Marks to be held by them in equal shares absolutely as tenants in common. I approve Charles Henry Alfred marks and Elijah Reuben Marks to the exectiors of the my last testament. I revoke all former wills by me and any time before made and declare this to be my last will and Testament.

Obituary.
We have to record the
death of a very old resident
of the Binda district, in the
person of Mr Richard Marks
which, occurred, at his sons
residence, Denison street
Crookwell, on Wednesday
afternoon at the age of 68
years. Deceased was suffer-
ing with a complication of
diseases and the end was not
unexpected. Mr. Marks was
a native of Markdale near
Binda, and was manager, of
the Woodville' station for a
number of years. Deceased
leaves five sons and one
daughter to mourn their loss,
the sons are, Ruben, Sydney,
Arthur (of Crookwell), Chas.
and Percy (Kialla) the daught-
ter being Annie of Binda.
Deceased was also a brother
of Eliza, (Richmond River)
and William, (Charleyville
Queensland) and Mesdames,
W. Picker (Bigga) and Joe
Reid (Sydney). He was also a
stepbrother of Mr. J. Camp-
bell (Rockley) and Mrs. Joe
Eldridge Wheeo. The funeral
will take place to-day when
the remains will be interred
in the C. E. Cemetery Binda
