DROUGHT LOSSES.
Leave was sought by James Milne grazier of St. Helens, Rowley-street, Burwood to enter into possession and exercise the power of sale over a property known as Bundure, at Mount Hope, near Hillston. Respondents were Thomas Macfarlane, storekeeper, of Hillston, Frank Laird, station inspector, of O'Connell-street Sydney; Robert Officer station manager of Hillston; Willis Price Conley Scott, grazier, of Hillston; and Dalgety and Co., Ltd., of Bligh- street, Sydney.
The application was before Judge Edwards in November, 1932. Judge Edwards postponed the matter for 12 months, but directed that the arrears of interest and current interest should be paid.
The present application was made on the ground of failure to comply with the Courts order.
Evidence was given that the property was held under a western lease expiring in 1943, and was valued at £10,271. The amount owing under the first mortgage together with arrears of interest and other outgoings, was £11,072. In addition there was a second mortgage to secure advances by Dalgety and Co., Ltd., for £4111.
For respondents it was contended that de-fault had been occasioned by serious drought as a result of which the property was now only carrying 1800 sheep, as compared with a normal capacity of 6000. They asked that any order should be postponed for six months, so that the property could be restocked if the season should prove favourable. Respondents had been offered assistance to do that.
During the hearing it was stated that the property had been purchased for £8000 in 1911, and was sold in 1926 for £18,700.
His Honor granted applicant leave to enter into possession and sell but directed that the mortgagors should be allowed two months to sell or remove their sheep.

Ltd., and Mr. R. Cecil Cook (instiucted by Messrs. Minter, Simpson, and Co. ) for Dalgety and Co., Ltd.
