COWRA -E. J, Muir appealed against disallowance of his conditional purchase application, No. 91-29, Cowra. Mr. Newell appeared for the appellant, and Mr. Carroll for the owner of the property selected. This case came under the operation of the Crown Lands Amendment Act passed in October last. The land applied for by Muir was part of Donald M'Innes's conditional purchase. 81-108, which was gazetted forfeited on the 30th December, 1884, but the forfeiture was subsequently reversed in December, 1885. Muir selected the land, rely-ing on the judgment of the Supreme Court in re O'Brien. He appealed against the disallowance of his application on the ground that the decision of the Supreme Court on the 7th May, 1891, "in re Robert O'Brien and the Crown Lands Act of 1889," rendered the land he applied for upon to the operation of the 26th section of the Crown Lands Act of 1884. The appeal had been sent in after the Supreme Court decision, and prior to the passing of the Validating Act of 1891. The President said the Act of 1891 had been passed for such cases. Where there had been a reversal the reversal was to be deemed to relate back to the date when the forfeiture was notified. There-fore it was quite plain that the former holder of the land had the land now. It was not Crown land. The appeal was dismissed, and the deposit ordered to be refunded.

OBITUARY.
THE LATE MR. E. J. MUIR
On Wednesday night at about half
past seven o'clock, we much regret to
record, Mr. Edwin James Muir, the
respected licensee of the Great Wes-
tern Hotel, breathed his last at his
residence. Although Mr. Muir had
been an intense sufferer for a con-
siderable period from kidney trouble,
which is believed to have had its
origin in an accident met with in his
early youth through a fall from a
horse, it was hoped by his relatives
and many friends that he would be
enabled to combat the complaint.
But, alas, it was not to be, a Higher
Destiny ruling otherwise. A sorrow-
ing wife (a daughter of the late Mr.
Alfred Cramp and Mrs. Cramp) and
one little son survive to mourn the
loss of a fond and devoted husband
and father. Other relatives of the
deceased gentleman are Messrs D. W.
(Albury) and J. H. (Cowra), Ald.
Robt. (Cowra), Miss M. J. (Cowra)
and Mrs. Redshaw (Young).
The late Mr. Muir was third
son of the late Mr. and Mrs.
John Muir, very old and much es-
teemed residents of our town and dis-
trict. He was a native of Cowra,
having been born here in 1867, conse-
quently he was in his 50th year. The
best part of his his life was passed in
the Cowra district, hence he was
widely known. Our sympathy goes
out to the sorrowing widow and be-
reaved relatives in the fullest meas-
ure. The remains were interred in
the Presbyterian portion of the ceme-
tery on Thursday in the presence of
a very large gathering of mourners.
The Rev. Jas. Barr officiated at the
graveside. The funeral arrangements
were carried out by Messrs. J. S.
Poignand & Co.
