[Evening News.]-Mrs. Davidson, wife of Captain George Davidson, of Mudgee, died this morning from inflammation of the lungs. This sad event is universally regretted. Mrs, Davidson was the third daughter of the late David Watt, squatter, of Pine Ridge, Denison town, and sister of Mr. David Innes Watt, J.P., of the same place.

FORECLOSURE OR SALE.
Watt v. M'Mahon.
Mr Leverrier, instructed by Messrs. Waldron and Dawson, appeared for the plaintiff and Mr Rich, instructed by Messrs. Ellis and Button, for the de-fendant. This was a motion for a decree of fore-closure of a mortgage, and defendant applied for a sale in lieu of fore closure. The plaintiff, David Innes Watt, had loaned money to Daniel Dominic M'Mahon on the Tooloom station on mortgage, the amount of the debt, including interest and ex-penses, mounting to £9000.
After argument his Honor directed defendant to pay £200 into court by February 1, 1893, and then the sale would take place in default of that payment the usual foreclosure decree would take effect.

RESERVED DECISIONS.
Reasons in extenso in re the appeal of Reginald George Nash against the recommendation of the Coonabarabran board in respect of David Innes Watt's application for surrender and exchange of certain lands on Toorawandi and Cowang holdings Nos. 278 and 696, Central Division, were given Appellant, the Court said, had entirely failed to sustain any of his grounds of appeal, which at the hearing were re-duced to this: That the exchange as proposed by the board would not afford appellant the permanent water he sought, and would entail greater expense than if he were allowed to extend his holding northerly, instead of easterly, on portions 10, 23, and 65 (Scotts). The evidence satisfied the Court that the objector (the appellant) would be in no way in- jured by having the chance of extending his holding northerly (Scott's) instead of in the direction he de- sired, which would he distinctly objectionable in the interest of future settlement. Moreover, his in-dividual interest, supposing even that the exchange as proposed would be prejudicial to it, could not be allowed to outweigh the public benefit's assured by such exchange. The case for the exchange was much stronger on this point than the case cited by Mr. Wise, K. C. (Porter v Gilchrist, 10 L.C.C. 6), for in that case Porter, the objector, would most probably be prevented from extending his area in any direction by the operation of the exchange. Secondly, the area offered for surrender and that asked to be granted was 10,707½ acres in each case, the former, valued at £l2,864 18s, the other at £12,987 15s, a difference of £122 17s, which excess value the ap-plicant had agreed to pay to the Crown. He had also agreed to the surrender of the improvements on the surrender land, valued at £1910 9s 6d beyond the value of the improvements on the land sought in exchange on condition of securing in exchange the improve-ments on the last-mentioned land. The Court had come to the conclusion that the exchange as proposed would be in the public as well as in applicant's in-terest as a consolidation of his holding, and therefore affirmed recommendation of the board. The ap- peal was dismissed with £3 3s costs on April 24 last.

ANOTHER ATTORNEY CALLED ON.
Mr. Blacket, instructed by Mr. T. Michell, appeared for the Law Institute, and moved on the affidavits of David Innes Watt, of Ul-inda, near Coolah, grazier, and the secretary of the institute, for a rule nisi calling upon an attorney of the Court to answer the mat-ters contained in the affidavits referred to, and to show cause. The transaction referred to was in respect of certain moneys advanced by Watt on mortgage, and he alleged that re-spondent had not accounted for a portion of the money advanced, and which was paid to him as solicitor for the mortgagors.
The rule was granted, and made returnable in a fortnight.

The estate of the late Mr. David Innes Watt, of New South Head-road, Woollahra, formerly of Ulinda, grazier, has for probate purposes been valued at £89,628, of which £21,210 represented realty and £50,248 vol-untary dispositions.
