WALES.-ECCLESIASTICAL JURISDICTION.-In the Will of CHARLES HEARN, late of the Bald-faced Stag Hotel, Leichhardt, near Sydney, in the colony of New South Wales. Licensed Victualler and Land Owner; deceased.
NOTICE is hereby given that after the expiration of four- teen days from the publication hereof in the New South Wales Government Gazette, application will be made to the Supreme Court of New South Wales, in its Ecclesiastical Jurisdiction, that Probate of the last Will and Testament of CHARLES HEARN, late of the Bald faced Stag Hotel, Leichhardt, near Sydney, in the colony of New South Wales, Licensed Victualler and Land Owner, deceased, who died on the twenty-seventh day of April, 1890, may be granted to Samuel Abraham Hearn, Alfred Ernest Hearn, and George William Hearn, of Leichhardt aforesaid, in the colony afore-said, the Executors in the said will named. Dated at Sydney this first day of May, 1890. FERGUSSON and BROAD, Proctors for the Executors, 28, Castlereagh-street, Sydney.

SAUNDERS V. FERGUSSON (PART HEARD).
Mr. Knox, instructed by Messrs. Curties and Barry, appeared for the plaintiffs, Eliza Saun-ders (wife of the defendant Alfred Percy Saun- ders), George Henry York, Emily Maud Fergus- son (wife of the defendant William John Fergusson), Hilton Arthur York, Osmond Harold York, and Inez Violet York, and Mr. A. H. Simpson, instructed by Messrs. Weaver and Hale, appeared for the defendantAlfred Ernest Hearn, Mr Knox said that the defendant William John Fergusson had appeared and disputed, but had not pleaded, all the other defendants submitted. The other defendants were AlfredPercy Saunders, Lancelot Threckeld Lloyd (official assignee of the estate of James Alfred York), and Inez Lewis. The plaintiffs prayed that an account might be taken of all moneys that had come to the hands of the defendants William John Fergurson and Alfred Ernest Hearn as trustees of the will of James York, deceased, and they asked that the trusts might be carried into effect under the direction of the Court.
His HONOR refused to order the defendant Hearn to bring money into court, and he made the usual decree for accounts in terms of the first and second prayers. He removed the defendant Fergusson from the trust, costs and further consideration reserved.

Re Alfred Ernest Hearn. The bankrupt de- posed that his bankruptcy was caused by an action which was brought against him by his aunt, Mrs. Saunders, in connection with Yorke's estate. Wit-ness was trustee with Mr. Ferguson, solicitor, of the estate of James Yorke, deceased. There was a deficiency in the accounts. Mr. Ferguson was the active trustee. He was witness's solicitor, Mrs. Saunders' son-in-law, and solicitor of the estate. There were defalcations, and Mrs. Saunders sued witness as trustee, and a decree was made against him for £8000 odd. He did not know what became of the money. He did not handle any of it. Witness was married on 26th July, 1893. Before he was mar-ried he executed a settlement on his wife of the Bald Faced Stag and a cottage, worth altogether about £4000. His wife's father, Mr. Benjamin Moore, had said that he would not allow his daughter to be married to witness unless he made a settlement upon her. Witness did not know that he was legally liable before the decree was made against him. He was entitled to property under his father's will, which was not included in the settlement.

MR. A. E. HEARN.
Mr Alfred Ernest Hearn, who died at his residence at Burwood yesterday, aged 77 years was an alderman of Leichhardt Council for about 21 years. He was Mayor of the Municipality in 1899. He owned a hotel for many years and subsequently acquired other property in the district. He is survived by Mrs. Hearn, three sons, and one daughter. The funeral will take place to-day.
