Notice is hereby given that Ernest Bruce Dear-ing, Stanley Robert Corben, and Anthony Thomas Moloney, of Marrickville and Surry Hills, have executed a Deed of Arrangement under Part 12 of the Commonwealth Bankruptcy Act, 1924-1930. All persons having claims against the said Ernest Bruce Dearing, Stanley Robert Corben, and Anthony Thomas Moloney are required to prove the same in the prescribed form forthwith. Any Creditor who fails to prove his claim will be excluded from all benefits under the Deed.

FACTORY DESTROYED BY FIRE
SYDNEY, Monday.-The S. R. Corben wood burning factory at New-town was completely gutted by fire early this morning, while six adjoin-ing houses were damaged. A number of firemen were severely affected by smoke. The flames spread with great rapidly, and near by tenants became alarmed and quickly abandoned their homes. Large stocks of Christmas toys were destroyed. More than 50 firemen were engaged combating the flames.

When a fire destroyed a timber-turning factory, owned by Mr. S. R. Corben, in Station Street. Newtown yesterday, the flames spread to the historic Reiby House (shown above) and severely damaged it. The old home was built by convicts 110 years ago.

DESIGN OF A CABINET.
Suit for Injunction.
Mr. Stanley Robert Corben, of 47 Alice Street, Newtown, is plaintiff in a suit against Nock and Kirby, Ltd. The plaintiff is a manufacturer of cuttlery cabinets and the substance of the dispute between the parties is wheather the defendant company infringed the plantiff's rights by selling a cabinet of certain design that had not been manufac-tured by him.
The plaintiff is the registered owner, under the Designs Act, of a design for a cabinet (No. 17,237), for five years from October 13, 1937. The design shows a cabinet with raised sides and a sunken lid. The manufactured article is stated to embody novel features, among them being an unhinged lid, which, on being raised, cannot be carried beyond the perpen-dicular. The plaintiff seeks injunction to restrain the defendant from selling cabinets of the design described in the specifications, and the usual orders in respect of delivery up and inquiry as to loss.
The defendant company denies breach and says that the alleged design was not new or original at the date of registration, that a person other than the plaintiff was the author of the design, and registration by the plain-tiff was not valid and that the alleged design was not a proper subject matter for registra-tion.
The hearing stands adjourned until next week.
Dr Frank Louat (instructed by Messrs. Gilbert M. Johnstone and Co.) appeared for plaintiff, and Mr Dudley Williams, K.C. and Mr. M. F. Hardie (instructed by Messrs. Perkins, Stevenson and Co.) for defendant.
