H.O. PATON & CO. have received instructions from William Pickering, Esq., Official Assignee, Brisbane, to sell by public auction, at the Commercial Hotel, on an early day, which will be duly advertised.
The whole of the superior Hotel Furniture and Effects, Platedware, Glassware and Sundries, Billiard Table, Bar Fittings, Wines and Spirits, &c., &c.
Together with The Lease and Goodwill of the Commercial Hotel, undoubtedly one of the best pay-ing houses in town.
Catalogues are now in course of preparation, and will be distributed prior to sale.

WE understand that the creditors in the in-solvent estate of Mr. John Cramp, hare de-termined on sending Mr. M. Bergin to Brisbane by the "Clarence," for the purpose of attending to their interests in the Insolvency Court.

MR. H. O. PATON'S sale of furniture and stock in the insolvent estate of John Cramp, at the Commercial Hotel, yesterday, was largely attended. The bidding was spirited and very satisfactory prices were realised. The sale lasted until nearly five o'clock, and the catalogue was not then exhausted. The auctioneer resumes operations this morning.

RE CRAMP.-In the insolvent estate of John Cramp, a third sitting was held. The insolvent was examined by the Attorney-General, and deposed that he commenced business as a pub-lican in August, 1865, in the Cambridge Arms, Cambridge-street, Rockhampton ; he afterwards carried on business at the "Commercial Hotel, Rockhampton ; he commenced business' at the Commercial on August 1, 1866, or about the last day of July, 1866 ; he had no capital when he commenced at the Cambridge Arms ; he was no better off when he commenced at the Com-mercial ; he owed money then ; speaking from memory, about £500 ; according to his bank-book, he had no money of his own then ; had no cash anywhere else ; his furniture and stock in-trade would be worth at that time fully from between £500 to £600 ; there was no charge or noumbrance upon his furniture and stock-in trade when he entered the Cambridge Arms ; he invested from £200 to £300 in furniture 'from money which he had before ; he afterwards added to the furniture ; when he en-tered the Commercial he had the furniture clear ; there was a meeting of his creditors at Mr. Lloyd's in March last ; did not at that meeting say that he had £200 or £300 in cash ; when he entered the Commercial Hotel he was asked by creditors, what money he had, and he said that he had £330, or about that sum, to his credit at the bank, but he said that included trust money ; could not say how much was ab-solutely his own ; the money was held by him on behalf of his wife's trustees ; the money was from the rents of property known as the Cri-terion Hotel, Rockhampton ; and a cottage in Anoher-street, Rockhampton ; the property was left to his wife and her two daughters by a former husband ; he paid £167 by promissory notes for the goodwill of the Commercial Hotel. In the month of January, 1867, the amount of his payments into the Union Bank of Australia, was £927 ; ho kept no other banking account ; he ceased to carry on business the day he filed his schedule (25th March, 1867) ; the last entry in his bank-book was February, 4, 1867 ; after the end of January, up to the time of filing his schedule, he deposited nothing in the bank; between the end of January and the 4th of February £115 10s was deposited in the bank ; it appears from the cash book that between the 4th February and the 25th of March insolvent received something over £500 ; from the 4th of February until the 4th of March insolvent's takings were not £800 ; the cash book truly shows the takings during that period ; the cash book produced commen-ces from August 1s 1866 ; insolvent kept a cash book the whole of the time he was in the Cambridge Arms, but it is not produced ; insol-vent gave it to H. O. Paton, agent for the official assignee, Mr. Pickering ; the book is not among those produced ; the cash book was not filled up when he left the Cambridge Arms ; he kept a waste book in the bar and entered up the cash weekly himself in his own handwriting from the 1st of August, 1866 ; he handed over to the official assignee on the 31st of March, 1867, £17 10s 3d ; the cash book shows what he has done with his cash takings from the 4th of February to that day ; on the 14th March he showed to his creditors £54 in hand ; that was afterwards paid away ; has no profit and loss account in the books ; the cash and bill book will show that he carried on a losing business ; the ledger contains no accounts with creditors, dobtors only ; it is not usual to keep an account with individual creditors ; has no stock book ; all bills receivable and payable are entered in the bills book ; up to the 4th of February, with the exception, perhaps, of some trifling amounts, he paid all money into the bank ; after the 1st March, 1867, he incurred a debt to Mr. Feez, for the usual supplies for carrying on business, to the amount of about £20 ; there is no entry on the 4th March, 1867, of a bill of A. Feez dishonored due on that date in the cash book in the cash book there is an entry of a promis-sory note of Walter Read's dishonored on the 4th March; there was, on the 7th March, a promissory note of Younger and M'William, for £34 4d. 1d., dishonored ; one of John Ward, on the 11thMarch, £120; one of William Patter son, on 17th of March, £43 0s. 7d. ; on the 11th March, J. B. Cunningham, £27 12s. ; on the same date, Bell and Gardiner, £20 4s. 5d. ; on the 13th of March, one of H. O. Paton, for £29 4s., was dishonored ; another on the 12th March, Thomas Elliott, £16 10s. ; if any other debts besides the £20 to Mr. Feez, between the, 1st and 12th of March, were incurred, they were merely for carrying on the house ; the account of Mr. Feez, as proved, is correct ; the day before the meeting with the creditors was held insolvent handed over goods to Mr. Melfit, a commercial traveller for the house of Dangar, Dangar and Co. ; they were creditors of insol-vent to the amount of £159 5s. ; insolvent gave Mr. Melfit certificates for goods in bond to the value of £70 ; the goods were colonial wines, cigars, and perhaps some brandy ; there was some claret-it was Australian claret-but sold as " claret;" these goods did not suit, and would have been sold at a great sacrifice if put in the market, so insolvent sold Melfit the certificates, with a view of wiping off the whole of the debt, and getting back the promissory note, which Melfit promised to do in the pre-sence of Wm. Lloyd; insolvent gave two bond warrants to Morris and Beckerley, creditors, in the end of January, for £100 that he borrowed from Morris to meet a bill. The insolvent was further examined as to the removal of furniture by him, or by his orders ; he denied that any such thing had taken place. The official assignee examined the insolvent, and the evidence tended to show that there was another John Cramp, of Banana, near Rockhampton, who appeared to have been mistaken for the insolvont. One debt was then proved for £126 3s. 9d. A claim by the Australian Joint Stock Bank for £377 10s. 6d. was rejected for informality ; £171 of the claim for rent being totally disallowed.The certificate was granted.

…In conclusion, we may mention that the luncheon was supplied by Mr. J. Cramp, of the Criterion Hotel, whose proficiency in such matters requires no comment.

Maria Cramp was charged with assaulting James Hazlehurst, while in the execution of his public duty as a bailiff in charge of property, in the insolvent estate of John Cramp (defen-dant's husband.) An objection to com-plainant's appointment as bailiff taken by Mr. Milford, for the defence, was overruled by the Bench. It appeared that on Friday last, the 12th instant, (the day after the sale of the Commercial Hotel, Quay-Street,) defendant was knocking down some shelving and fixtures with an axe. Complainant told her it would do her no good to do, and to leave them for the person who had bought the good-will of the house. She slapped him on the face several times, and subsequently, when he left the bar to give delivery of some beer, she took possession of the bar, and would not lot him in. Fined 20s., with 7s. costs of Court.
