Tuesday, October 16Before Judge Paine The hearing was continued and further ad-mited of a case in which John and Henry Edgar Coles, for whom Mr. H. G. Alderman ap-peared, sued Sydney James Sweet, farmer, of Jervis-aveneue, Magill. represented by Mr. L.D. Waterhouse, for £52 6/6. It was alleged that the amount was due for commission on the sale of a farm to William James Leo Allan.
The defendant's plea was not indebted and that if the plaintiffs sold the farm they did so without his authority.

Tuesday, October 30.(Before His Honor Judge Paine.)
John Coles and Henry Edgar Jones (Carrying on business as John Coles & Son), land and estate agents, claimed from Sydney James Sweet, of Jervois-avenue. Magill, Farmer, £52 6/6,commission and money advanced, alleged to be due on sale of 1,450 acres. Hundred of Coney-beer, to William James Leo Allan, of Adelaide, for £1,500. The defendants pleaded not in-debited, and that if the plaintiff sold the pro-perty them did so without the defendant's au-thority. Mr. H. G. Alderman appeared for the plaintiffs, and Mr. H. G. Waterhouse for the defendant. His Honor, in his reserved judg-ment, said the statement in the contract signed by the defendant was sufficient to satisfy the Land Agents Act. As to the charges of fraud, the evidence of the defendant in important as-pects could not be accepted. Witnesses for the plaintiffs appeared to be honest and candid. Sweet knew the motive and contents of the documents he signed, and that was no concealment of facts which could reasonably affect his decision. The defendant was not misled, and the plaintiffs had made proper efforts to obtain the best price. Judgment tor £51 11/6, with costs.
