TRUSKETT v TRUSKETT
In this case both husband and wife asked for divorce in cross-petitions Douglas Laurance Truskett, police constable peti-tioned for the dissolution of his marriage with Hazel Heather Truskett (formerly Francis) on the ground of adultery with Thomas V. Lyons, gaol warder, who was joined as co-respondent.
The wife and the co-respondent denied adultery and the wife raised the issue whether her husband had committed adultery with one Gladys Skinner. The wife asked for divorce on that ground the husband de-nied his wife's allegation of adultery against him.
The petitioner and respondent weir mar-ried at Mendooran on December 10, 1930,according to the rites of the Presbyterian Church.
At the close of the husband's case the co-respondent on the application of Mr. McClemens, his counsel, was dismissed from the suit on the ground that there was no evidence against him.
His Honor then allowed the petition and issues to be amended by adding a charge of adultery by the wife with a man whose name is unknown to the petitioner.
The case is not concluded.

TRUSKETT v TRUSKETT.
The hearing was concluded of these cross petitions by the husband and wife, who both asked for divorce. Douglas Laurance Trus-kett, police constable, petitioned for the dis-solution of his marriage with Hazel Heather Truskett (formerly Francis) on the ground of adultery with a man whose name is un-known to the petitioner. The wife denied adultery, and raised the issue whether her husband committed adultery with one Gladys Skinner. The wife asked for divorce on that ground.
In his evidence the husband denied adul-tery, and said the charge against him was a fabrication.
On the first day of the hearing, Thomas V. Lyons, who had been Joined as co-respondent, and who was charged with adultery with Mrs. Truskett, was dismissed from the suit on the ground that there was no evidence against him. The Issues were then amended to a charge of adultery against the wife with a man unknown.
In dismissing both petitions, his Honor said he had to be satisfied, beyond reasonable doubt, that a typewritten confession, alleged to have been made by the wife, that she had committed adultery with the co-respondent, was bona fide. There were several reasons disclosed by the evidence which made him doubt the whole bona fides of that confession. With regard to the wife's adultery with a man unknown, the best he could say about that was that i might or might not have occurred. He was not satisfied beyond rea-sonable doubt that adultery with a man un-known was committed, and that being so that issue was found in the negative. The issue raised by the wife against her husband was also found in the negative.
His Honor then dismissed both petitions, and ordered the husband to pay the wife's costs.
