Shannon, in the in which Thomas Robert John Blackman and his wife, Mary Elizabeth applied, under section 175b of the Land Acts, 1910 to 1930, for a that speclal reasons existed for the sale of five special leases them without competition, and, further, for a deter- mination .of the to be charged for the land comprised in these leases. Doubtless, because of possibility of abuse, and, because of the curtailment of public involved in sales of land without competition, such sales in the had been confined to a severely re- stricted class of cases, and, the door had, perhaps, been opened somewhat wider by section 16 of Act last ses- sion, it, nevertheless, required that the court should be in the class of cases covered by that section that special reasons for a sale under its pro- visions. In the present case the evidence not satisfy him that special reasons existed for the sale of the land to applicants under the section mentioned, which was now section 175b of prin- cipal Act. The valuation furnished to the court by the Minister one of £97/5/3 per acre, made in connection, with proposals by by the officers of the Lands De- partment for the opening of the land for farm or perpetual lease selec- tion. It was admitted in that this valuation would have been lower but for the mistaken that a sale used as a basis was of an unimproved property instead of fairly well improved. The evidence did not disclose any objection on grounds to the offering of the land for sale by auction, and pointed to that as the most suitable means In the circumstances meeting the not unreasonable desire of the appli- cants for a better The evidence warranted the view that, in the event of that course followed, a fair upset price would not exceed £36 per acre.
