A QUARRELSOME HORSE.E. J. Cramp claimed from Jas. Alexander the sum of £17 19s 6d damages alleged to have been done by defendant's horse. Mr Cater appeared for plaintiff. Mr Alexander con-ducted his own defence. It appeared from the evidence that the parties are owners of contiguous properties. On various occasions defendant's horse got into plaintiff's holding and on the night of the November 20 it quarreled with plaintiff's horses and kicked one of them on the head. The animal was incapacitated from work and, though carefully treated, died a few days afterwards.
The defences were (I) denial of trespass; (2) contributory negligence, plaintiff being part owner of a decayed and worn-out dividing fence; (3) that on the 23rd January defendant's horse was taken from his block and put in plaintiff's fig block.
Plaintiff stated that on the 21st No-vember, in consequence of what his daughter told him, he went to his barley patch and assisted to turn de-fendant's horse outof the block. One of his own horses appeared to be seedy and as Alexander's horse passed it bit the animal over the ribs. A close examination disclosed a bigs welling on the head of -plaintiff's horse. As the animal did not improve during the day a neighbor named Baldwin was called in and the two treated the animal. A week later the animal died. He valued the horse at£12 and claimed that sum from de-fendant, who, though at first offering some recompense, declined to pay damages. In January of this year defendant's horse trespassed again and id damage among the vines to the extent of £5. The dividing fence was of netting and two wires and he had never seen any other horse pass through it.
Cross-examined, plaintiff stated that his cow had on one occasion got into defendant's block. Defendant had been for five years his neighbor and had been a good neighbor throughout.
George Baldwin, sen.; corroborated plaintiff's evidence about the injury done to the horse on 22nd November. Witness attended it daily for several days, but it died. Witness conducted a post-mortem examination. The in-ternal organs were sound, but the head contained congealed blood and matter, while there was a bruise over the temple corresponding to the size of a horse's hoof. In January wit-ness saw defendant's horse in plain-tiff's vines. It had done considerable damage, which he assessed at £10.
[The case was not concluded by 6p.m. on Wednesday, so an adjourn-ment was made till Thursday.] resuming after luncheon onT hursday other witnesses were ex-amined, including defendant, who stated that he did not believe that his horse had injured Cramp's horse. When Cramp complained that his horse had trespassed defendant said."Let us strengthen the fence." This they did, defendant supplying barbed wire and the two erecting it. When Cramp's horse died he asked defend-ant for £4 to assist in buying another. Defendant replied that if proof was forthcoming that his horse had killed the other he would hand over its value. Defendant further deposed that he saw his horse on his own land on the23rd January 20 minutes before Cramp came to him to tell him of the damage done to his vines.
His Honor considered that plaintiff had proved trespass. It was a mis-take to think that because a dividing fence was not in good repair a neigh-bor was exempt from damages for trespass by stock. A man was bound to keep his horse within his own boundary and if it got beyond this then he must bear the consequences. In view of the fact that Mr Smales had stated that he offered the horse six years previously at £8 he would reduce the claim and make an order for £10 only, to cover the value of horse and damage to vines. The costs were fixed at £6 6s.

E. J. Cramp (Major Brown) v Mrs. A. G. Roberts; claim for 9 6 balance of wages due. Complainant said he was engaged by Mrs Roberts to dry the currant crop at 9/-a day --viz. 8/-for himself and 1/-for the use of a horse, and 6/-:a day for his boy. They worked 8¾ hours per day. At the end of live days Mrs Roberts objected to pay 1/-for the horse or anything for the time worked over 8 hours, so he ceased work. Defendant gave him an order on the Irymple Packing Co. for £3 10/-; he now claimed the balance, charging only for half-an-hour per day instead of the three-quarters actually worked and the hire of the horse. Defendant stated that she considered Cramp and his son were amply paid; the use of the horse was unjustified, and even if it was, the feed it obtained in the paddock all day would more than pay for its hire. An order was made for the amount claimed, with 21/-costs.

I think that there may be two families in here. I just cannot tell. There are two sources. The NSW BDM and the National Archives of Australia, which not only claims that Charles Netley Cramp has no known fathere and is the son of Ann Cramp, but then goes on to list many of his brothers and sisters.
